So what a wonderful trick,....in April I am current based on the Visa Bulletin, but now their processing has moved backwards to June and that means no luck for all July filers.....what a joke....:(

Having spoken with several congressional aids I can say that such issues are well received. The specific issue that I have raised (it does not affect me) is examples of people leaving USA and having to explain to their US born children why mummy and daddy are not welcome in the USA, and thus why they have to grow up in a foreign country.
I have also given examples of one sibling being born in USA and other aging out.
However, I have only raised this where law makers are known to be sympathetic to family immigration, e.g. support DREAM.
I think that the best we can do is:
Get wait times down (and reduce impact of this).
Use this as an argument with those who support family based immigration (and may even be hostile to EB otherwise).
If we have an opportunity to address this as part of other EB legislation we can.
It is certainly not forgotten by me.
I do think that it would be helpful to have a list of people in IV with this problem (with ages of all children plus relevant dates). For the moment I'm too busy to organize this (busy with IV work -- like 4am bed times).
More active help (not just forum discussion) with IV is always welcome, so you are welcome to step up and help (e.g. compiling a list of such members etc.). Politics is personal so being able to present personal cases is helpful.

Folks,
It seems sun didn't rise from the east or has it....the miracle has happened....after 10 years and 25 days in this country with 2 advanced degrees and with days of ups and downs ...days of confusion and frustrations I finally received a mail:
Here it goes:
Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Approval notice sent.
On September 3, 2009, we mailed you a notice that we have approved this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS. Please follow any instructions on the notice. If you move before you receive the notice, call customer service.
You can choose to receive automatic case status updates, which will be sent via email. Please click here to create an account online.
Most of the folks in the forum receive "Welcome and CPO" message...did anyone receive this kind of message? Is it too early to rejoice? (well excuse my cynicism)...wife didn't get such a mail so it is not over yet....
The details of my journey:
Filed in California for Labor right after 9/11...worked their for 2 years company filed Ch-11 and with that went my hope for GC from them....fortunately got a job and moved to the "Bay state"
Labor: 07/12/2004
Stuck in BEC for 2.5 years
I-140 received : 01/25/2007
I-140 approved: 06/25/2009
I-485 mailed 07/23/2007 to TSC...got shuttled to CSC for data entry and kicked back to TSC and
ND of 09/25/2007
FP : 11/01/2007

Received approval notice on I-485 at 5:30 AM on 09/04/2009.

There is one major flaw in your lawyers analysis.
He is correct in saying that they issued 11,111 GC's per monththis year, but however that was under retrogression when dates were so far behind (dates for EB2 and EB3 India hadnt moved for ever). His analysis does not take into account those whose 485's may have been pre approved but were not issued a GC due to date not being current. We are not talking about new applications being approved but those whose applications were already preapproved and just waiting for visa numbers.
Anyway no one knopws what will really happen. Just file as early as possible and leave the rest to luck or divine power. Jo hoga dekha jayega, but this is not the time for tyupical desi procascination.
Very well said.. This will give a little hope to everybody..
Thanks for your post.
QUOTE=shantak]Here is what my attorney has sent regarding the AILA release, i dont know whether to believe him or other attorneys, i think i have no choice but to go with what my attorney says.He has been really good in these kinds ofnotices for the past 3 plus years, hope he is correct even with this.
1)There is no way that USCIS would get away with shutting down filing of EB-1, EB-2 and EB-3 Adjustment filings without a massive class action lawsuit against the agency;
2)The power to determine the availability or non-availability of permanent residence visa numbers rests solely with the Department of State. USCIS rejected the Other Worker Adjustments based upon a notice from the Department of State that there were no longer any visa numbers for the category. I recently attended our annual AILA immigration conference and there were members in attendance who had interviewed the Department of State official who sets the priority dates. The understanding was unequivocal that the Department of State office felt the numbers would remain available throughout July, and perhaps, as late as September;
3)At this time, there are 40,000 immigrant visa numbers available for the rest of the fiscal year. This means that in order for the Department of State to issue any kind of notice to USCIS, 40,000 permanent residence petitions would have to be APPROVED prior to the end of July. I am highlighting the word approved, because I need for all of my clients to understand that between June and July, there will a lot more than 40,000 Adjustments filed. However, what determines an immigrant visa number usage is the approval of a permanent residence.
Now lets go back to simple math: there are 140,000 immigrant visas available per fiscal year. 40,000 visa numbers are available at this time. The fiscal year runs from October 1st through September 30th. That means that in the first 9 months of the fiscal year, the Department of State and USCIS have managed to approve 100,000, which turns out to be 11,111 petitions per month. There is no possible way that USCIS and the Department of State are going to approve almost 4 times the number of permanent residencies in the month of July. The agencies do not have the time, nor do they have the manpower to approve 40,000 petitions within the next 30 days or so. That is the very reason why the Department of State official solely responsible for the priority dates felt pretty good about the availability of visa numbers throughout the month of July when he spoke to my colleagues from AILA.
To be honest with all of you, I was really disappointed in the message from AILA. In the rush to inform, they forgot to pause, analyze and really discuss the true possibility that USCIS would be directed by the Department of State to halt receipt of Adjustment of Status petitions. I want my clients to know this: at this point, I am not worried that the visa numbers will not be available throughout July. If I were worried, I would let you know. My responsibility is to guide you through this process and if there is any genuine worry on my part, I will let you know IMMEDIATELY.[/QUOTE]

I live in Los Angeles and sent my paper-based application to Nebraska. it reached on May 01 but no reciept or check cashed yet.
I know After reading this forum that I should have mailed to Phoenix lockbox instead on Nebraska service center.
Anyone in the same boat?. Do i need to file again or wait for USCIS to forward it to Phoenix lockbox.

All those who answered were right! You don't have to reapply H4 for your dependants when you change employers as long as their current status is still valid. I changed employers in 2004 and didn't have to apply new H4 for my family until 2006 when their previous status expired.
On another note, one does not need a new visa stamp in passport when one changes employers until current visa stamp expires.
I hope this puts your mind at rest. You may however want to confirm this with your lawyer and post his answer.
