It seems some people already coverted\or in the process of coverting from Eb3 to Eb2. Even I did that recently.

When you do that, will you retain both cases or give up one?
And, say, my case is CP and is already in Consulate awaiting interview. If I start a new LC in EB2, do I have to give up my existing case?

Accenture and other big firms will survive without H1b by recruiting GC holders ,Citizens, L1 and B1. So there will not be any long term impact because of this bill. Still most of the H1 cap will be filled as the companies will try to comply the regulations. I do not see any issue in proving that no USA workers available if it is really the case. Right now if H1b and US worker is available with same skills Indian companies are purposefully avoiding US workers for obivious reasons. We everyone aware of it. Because we are impacted personally we are opposing this bill. This attitude will not win. We should be ready for some compromise if deadlock

In effect, discriminate between employees of one set of companies with the employee of other set of companies? Let me guess, you do not work for one set of companies but may possible work for another set of companies, right? With the green card backlogs, a lot of companies have many employees on H-1B status, waiting for their green card. As such the ratio of people on H1 to green card is increasing. Why do you want to punish the employee on H1, waiting for the green card for many years, because of retrogression? I am not able to understand the objective and rationale of your suggestion?

So in essence, the bill says that as soon as you employ someone on H1, you have done something wrong. Even after listing the job on DOL website for 30 days and going through all the other stringent requirements, is that how it should be? When an employer hire an employee on H1, the employer is paying filing fee, lawyer’s fee and 8-10% taxes for hiring each employee. This "Investigation" and other stringent provisions to make it impractical to file H1 is simply to destroy H1 program. For now you may see the bill as to how it best suits your individual situation and then you may suggest how it further fit exactly into your situation before coming with an idea, like the one you suggested, but the bottom line is, this bill makes entire H1 program "non-workable" as mentioned by the administrator. And it applies to Oracle & IBM Consulting, PWC, Deloitte and every other employer.

Is this happening this year too - TSC is giving approvals and not NSC? Last Aug / September when my priority date was current - it was the same, i know of people who got approved from TSC whose PD were 12/05.

so is this kind of information only available to donors. i think it might be worth the money if we can get this kind of information for a year ahead so we can plan accordingly. is it a monthly update that we will know ahead of time or is it a quarterly , semi annual or an annual planning activity. please let me know

Reverting back to the original interpretation for allocating unused visa from other category and to oversubscribed country from the current new interpretation seems to be the only possible quick relief to EB3, though EB2 gets affected it is not going to be that severe.

If we can approach the USCIS /DOS for Admin fix in this area, this should be possible, given that IV already has some success in the Admin Fix area. But seeing the lack of response from core IV for this particular thread (Overall they do a good job) regarding spill over, visa allocation, makes me this, core IV is not thinking there is an error with the new interpretation or IV was one of the main source that was instrumental for this change. The new spillover helps only India (EB2) looking at the number of pending cases from China and ROW. China hardly has less than 1000 cases prior to Mar '05 PD for EB2.
I'm not sure what happened to fellow EB3 ROW members... These folks at least will be current soon.. and India / China cutoff date will move the later PD very soon.

Thanks santb1975 & NolaIndian for creating this. I am going to ask a friend who ran half marathon last year. I am still contemplating whether I will be able to keep the commitment, since the only exercise I do is walk to and from my car :D

I walked 12 miles yesterday. Today i feel the pain when i walk. Anyways, you can count me in for that part. I am not sure if i can commit myself to the SF event... I need some more time to make up my mind.

I'm in a similar situation and I want to ask you if DOL withdrawn your file from the backlog center if you had a PERM application approved.
Is it Ok to have one application pending in the Backlog center and a PERM Labor certification approved if the applications are for 2 different jobs?

I had observed this last summer also that most of the CPO emails are received at night. In my opinion, it is probably due to the fact that they run these external communications as batch jobs at night, which is usually the case in any high volume corporate type IT systems.

My wife and son are going to India on vacation this summer. Their current H4 visa got expired (June 2006) on their passports. They have a valid I-797 notice expiring Oct 2007.
However, I am applying my H1B extension next month and will get 3 years extension sometime in May 2007. I want to get them visa stamp based on my new approval notice.
For dependent H4 visa stamp, do they need their own approval notice 797 or principal's approval notice be sufficient to get the stamping?
